Taxi Drivers - Change to level of Check

Last month, the government announced that they will change the law to allow taxi licencing authorities to apply for Enhanced CRB Checks for all taxi licensing applications. When this change comes into force, licensing authorities will be able to check whether the person applying for a taxi licence is also barred from working with children or vulnerable adults as part of the Enhanced Check.

As the law stands at the moment, licensing authorities can only apply for an Enhanced Check on drivers who regularly pick up children or vulnerable adults; however, it has become commonplace for many licensing authorities to apply for Enhanced Checks for all taxi and private hire licences.

This change requires secondary legislation and as yet we don't have a date for it's introduction, but the CRB will keep us posted. In the meantime, taxi licensing authorities should continue to apply the current legislation.
